The Maria Mercedes 17 and the Maria Mercedes 11 were repeatedly sanctioned for exceeding their authorized storage capacity at least as far back as June 2020. In each instance, a portion of the anchovy resource was seized and Pesquera Exalmar was obliged to pay a fine in the amount equal to the commercial value of the fish. At the same time, one of the legal reports notes that if a company’s rate of recidivism reaches two or more sanctions for the same infraction in one calendar year, the fine will increase by 100 percent each time a repeated sanction is finalized.
